Isensix™ provides access to various healthcare monitoring data, including but not limited to temperatures from monitoring units in hospitals and laboratories ("the Service"). This data includes self-diagnostics communicated between electronic devices and computers, which are essential for Isensix™ to deliver the Service. Any new features enhancing the current Service are subject to the TOS. The Service is provided "AS-IS," and Isensix™ will make reasonable efforts to remedy any reported malfunctions.
Upon completing the registration process, you will receive a password and account designation. These may also be provided by your organization's IT staff. You are responsible for maintaining the confidentiality of your account and password and are fully accountable for all activities under them. You agree to:

Isensix™ may preserve and disclose information collected during normal operations if required by law or to protect the rights, property, or safety of Isensix™, its users, and the public. You acknowledge that the transmission and processing of data may involve various networks and may be modified to conform to technical requirements.
Given the global nature of the Internet, you agree to comply with all applicable local, state, and federal regulations.
Isensix™ does not claim ownership of information you submit for inclusion in the Service. However, Isensix™ may use such information to enhance the Service, maintaining its confidentiality unless otherwise noted.
You agree to indemnify and hold Isensix™, its subsidiaries, affiliates, officers, agents, and employees harmless from any claims or demands, including reasonable attorneys' fees, arising from your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service for commercial purposes.
You acknowledge that Isensix™ may establish general practices and limits concerning the use of the Service, such as the maximum disk space allocated on its servers and the maximum duration and frequency of access to the Service. Isensix™ is not responsible for the deletion or failure to store any data or communications, and reserves the right to change these practices at any time, with or without notice.
Isensix™ reserves the right to modify or discontinue the Service at any time, whether temporarily for maintenance or permanently upon subscription termination. Isensix™ is not liable for any modifications, suspensions, or discontinuance of the Service.
Isensix™ may discontinue providing the Service at its discretion, with or without notice, upon termination of your subscription. Isensix™ may deactivate or delete your account and related data without prior notice, and is not liable for such termination.
The Service and any software used in connection with it contain proprietary information protected by intellectual property laws. You agree not to modify, rent, lease, sell, or create derivative works based on the Service or software, except as authorized by Isensix™. Isensix™ grants you a non-transferable, non-exclusive license to use the software on a single computer, provided you do not attempt to discover the source code or use modified versions of the software.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Therefore, some of the limitations in Sections 12 and 13 may not apply to you.

Isensix™, the Isensix™ logo, "It's Your Health!", Guardian, ARMS, ACT, Active55, Active16, and other Isensix™ product names are trademarks of Isensix™, Inc. Without prior permission, you agree not to display or use Isensix™ trademarks.
The TOS constitutes the entire agreement between you and Isensix™ regarding your use of the Service, superseding any prior agreements. The TOS is governed by the laws of California, and any disputes shall be resolved in the courts of San Diego, California. Failure by Isensix™ to enforce any provision of the TOS does not constitute a waiver. If any provision is found invalid by a court, the remaining provisions remain in effect. Any claim related to the Service must be filed within one year or be forever barred.
